Doug Henderson reveals only the Lord knows when he can make a decision regarding police sex case.

Late last week the N&R reported that the D.A. expected to decide today if criminal charges would be filed against three Greensboro Police Officers that allegedly sexually assaulted a female Greensboro Police Officer. That story is below.

N&R Friday, Mar. 14, 2008:"The Guilford County district attorney expects to have a decision Monday on whether criminal charges should be filed in a sexual assault allegation against three Greensboro police officers.

District Attorney Doug Henderson said Thursday afternoon that he has received the transcripts of interviews conducted in the police investigation. He received the investigative file early last week, but the transcribing of the interviews was delayed.

Three officers have been suspended with pay since a fourth officer reported Dec. 18 that she was sexually assaulted. The three officers, members of the police department’s Tactical Special Enforcement Team, are: Sgt. A.S. Wallace, 43; Officer J.O. LeGrand, 37; and Officer C.S. Stevens, 42.

A female officer reported on Dec. 18 that she was sexually assaulted by other officers after they picked her up near the Four Seasons Town Centre.

The assault was reported to have happened between 11 p.m. Dec. 14 and 1 a.m. Dec. 15.
A group of senior prosecutors will go over the case with Henderson. He typically calls in such reviews in more serious cases. This one qualified for the more extensive review because of the type of charge and because members of the law enforcement community are involved, Henderson has said. He might have a decision by noon Monday, Henderson said."

However, today there is a story in the N&R reporting that there is another delay in the sex assault case. That story is below.

N&R Monday, Mar. 17, 2008: "It will be weeks before District Attorney Doug Henderson can give his recommendation on whether to charge or clear three officers accused of sexual assault last December.

The most recent delay in the investigation comes because physical evidence sent to the State Bureau of Investigation crime lab has not yet been analyzed, Henderson said.

Henderson faxed the agency a request to expedite the analysis, a move he hopes will speed results. He would not say what physical evidence is being analyzed.

"If it were not expedited, it would probably be a matter of months," Henderson said. How long the analysis will take now depends on how many other expedited investigations the SBI is working on, but Henderson said results would likely come in a few weeks.

"When it will be done, lord only knows and we won't make a final decision until it is," Henderson said.

On Dec. 18, a female police officer reported that she was sexually assaulted by other officers after they picked her up near the Four Seasons Town Centre. The assault was reported to have happened between 11 p.m. Dec. 14 and 1 a.m. Dec. 15.

Sgt. A.S. Wallace, 43; Officer J.O. LeGrand, 37; and Officer C.S. Stevens, 42, members of the police department's Tactical Special Enforcement Team, have been suspended with pay since Dec. 18.

Greensboro police do not release the names of people who report being sexually assaulted. The News & Record does not identify people who claim to have been sexually assaulted unless they give their permission."

Can you see the conflict between the two articles? If you don't see the difference let's review the first sentence of each story and compare them.

Last Friday: "The Guilford County district attorney expects to have a decision Monday on whether criminal charges should be filed in a sexual assault allegation against three Greensboro police officers."

Today: "It will be weeks before District Attorney Doug Henderson can give his recommendation on whether to charge or clear three officers accused of sexual assault last December."

How did days become weeks? How can the N&R not mention the D.A.'s statement reported last Friday? How did the D.A. think he would have a decision by today when the S.B.I. crime lab had not given results of physical evidence? Friday he said his decision might be made by noon today and two days later he said the
lord only knows when he will make a decision? What was that box of stuff delivered to the D.A. today?

What do you expect from a DA's office that want even trie cases. Thats why the jail is over crowed. He is another one who is costing the Tax payers so much money. Also if he dosen't get his ass and staff in gear watch and bare the cost of a new jail. B.J.Barns knows what he is talking about. If we don't build the new jail, and the Fed's take over, then don't blame Barns for your tax bill. So Henderson, and staff, need to stop taking time off for golf and sending everything to pretrial release and try cases. You will always hear excuses from Henderson, and the cases with this officer's will never see a court room.

what did you expect from a career defense attorney!!! he'll made a decision when joe tells him too!!!

Why do you care? You already guaranteed us that there would be no charges in the case.

It's time we all realize that Henderson is working for the other side still...defending criminals.

Ben,

What's up baby! I have got to give you due respect on this article. Now, that is getting closer to true journalism and not tabloid. It was still outside the realm of journalism rules, but at the same time you are posting it on your own site so you have a litle play room. This was a good article displaying the facts of what is going on with the case. Good Job! That is more like the legendary Ben Holder that people buzz about before you started this troublemaker thing.

One thing though BEN: As far as CONFICT BETWEEN THE TWO ARTICLES: I am failing to understand why you are confused. Im am truly not being sarcastic, honestly. But You wrote an excellent article that said the D.A. thought he was going to have a decision by a certain date and told the N&R (which I agree is not the best newspaper, but it doesnt mean they are ALL the way bad) the same thing. You evn had an earlier article where you reported the same thing. Then in your article you did an excellent job of rexplaining the problems with physical evidence taking a while at the SBI. Which is ture because that lab examines evidence statewide. We all know of at least one case where the evidence is being expidited ahead of this one, the Eve Carson case. So obviously the D.A. was dependant on having the sufficient evidence to make an in informed decision. Such evidence which he now knows is not entirely available. Therefore what he thought was going to be ready is not ready and now he tod the N&R the same thing. You reported basically what I just said in your own story. Therefore, I say again, I am truly not being sarcastic. I am really having trouble understanding the reason why you are confused about the conflict in the to articles.

Now, as for a couple of other people who posted...

The the person who poste about the city council meeting to "switch focus and stall"....I couldn't agree more. Well said!

To the person who wrote "...Still defending criminals" Now of course what you wrote gives the implication that you FIRMLY think the officers are guilty. I mean to get on the world wide web and call the men criminals, that takes major guts. So much guts that, in order to do that, you must absolutely know for sure that they did it. Now obviously if you are going have the fortitude to get on the world wide web and say they are criminials, then surely you were man enough to go to the police with your information. Surely, you were man enough to give your deposition to the D.A.'s office. Maybe that's the hold up in the evidence. They are waiting for you to make an appointment to give your account of the events. I mean you do have an account of the events to give, right? I mean you are on the world wide web making definitive statments to their guilt. In order to do that, you must know they did it. In order to be so absolutely sure they did it you must have been there. That's the only way a person can be sure. I mean when you are sure, you can;t say someone told you they did it because they could be lying. No, no, no. You got on the world wide web, which means you know for sure that they did it and that you were there. Now of course, when this is all said and done, some of us are going to go the the 201 S. Eugene St. at the Guilford County Clerk of Courts office and pull the case files and transcripts when they become available and look for your deposition. Because surely a man or woman of such upstanding principle to get on the world wide web and call them criminials was upstanding enough to give a deposition.

Now me, I don't have to live up to that standard. Why, because I'm a hypocrite? No. Because didnt place myself in a position to say I know what they did or didn't do either way. Therefore I am not responsibl for defending my position because I dont have a position on their guilt or innocence. I wasn't there. I don't know if they assaulted the woman or not. I do not have a clue. Therefore, I am not making a judgement either way.

Am I saying that someone who wasn't there isn't allowed to have an opinion? Heck Naw! Opinions are fine. What is not okay is when your opinion is given off as factual evidence. See if someone wrote on here, "Hey, I think they did it!" That's okay because that's their opinion. They have the right to believe it. If someone got on here and said, "Hey I think they are innocent" That's okay too. Because they are entitle to their own opinion. The only problem with some people being entitled to their opinion is that some folks get married to their opinion without any possibility of divorce. This is called being "closed-minded". Being "closed-minded" is a direct precedant to being "prejudice." How so, one might ask. Well, here is how. See when a person is closed minded and not open to the possibility of new light being shed that might offer a new angle or a different picture altogether, they prejudge any thing that is presented it and either negate it with out study, or they study it improperly and can only use the new evidence to further support their preconceived understanding of the truth.

This is much of what we see on a plethora of comments on issues on this site and with you, Sir. You have somehow come to an absolute conclusin on this issue so that no matter what is presented, even if GOD himself cracked the sky and said his position on it, you would still be like, "nope, I see it my way." Being closed to the truth. Ina place of utter deception. That is a dangerous place to be. Its the same mental state that causes people to turn away from Christ.

However, Sir. None of he above applies to you at all, if you truly know that they did it. If you were a witness to what took place then you have every right to be on the web, on TV, in the news and everywhere profesing to what you know. Just make sure you stop by the D.A.'s office, because if you are siting on information about a crime and you don't share it, then you are just as criminal as you are claiming them to be.

My only hope is that you are not being a false witness to your brothers under GOD. Like it or not they are your brothers. Back in the old days if a man accused someone of acrime and could not prove it, then the accuser would have to suffer the consequences that the accused would have faced if found guilty. Maybe if things were still done that way, WE and again I say WE as a people, as a society or perhaps at least as residents of Guilford County would be more careful about speaking so publicly and so harshly of things we know not of.

I have no reason to believe that you do or don't know for sure if they did it. But i do know this, whether they are cleared or not, you don't have to answer to anyone but God about your caling them criminals. Hopefully God will agree with you on what you say about your fellow man.

I have now learned to stop subitting comments that judge people, but to rather lay out the prinicple. And if the shoe fits the prinicple then it is what it is. Not because I say so, but because it fits the principle.

Call me a hypocrite if you like, but Im not afraid to admit when I am wrong in principle. Not wrong because you say I am wrong. But wrong because I am out of line with t he prinicple of the matter. Then you can say I am wrong. And that's okay. I can admit it. Can some of you? Or are you married to your opinions with out chance of divorce thereby making yourself unavailble to the TRUTH and will only scoop up the evidence that lends credence to your version of the truth. So that when the TRUTH is presented to you, you are blind to it and reject it. The first step to not ending up that way is to understand that its okay to say, I don't know.

Anonymous said...

To the above who likes to ramble on and on and on....it's the likes of those running the police department and the city leaders that choose to reject the TRUTH when it is presented to them. Rogers, Fullmore, Wallace, James, Chandler and Hinson...all names repeatedly entangled and invloved with known felons. The evidence exist but it always gets hidden.
It stinks for GPD that these officers happen to be black. If not then you bet they would all be gone and the GPD could rebuild it's reputation.

Anonymous said...

You mentioned Lape in one of your earlier diatribes as well. Is he still employed? No! The list of “offenders” goes on and on. And there is a pattern of black officers getting away with destroying the GPD’s reputation and nothing is being done about it! Shut up with the long discourse that in the end says nothing. We get your point. You are voting for Obama! After all, we were not sitting in the pew when his preacher spoke.

To the person that wrote the long post, where did you read that the other person implied the officers were guilty?
My opinion is you ride the short bus, just my opinion.

Nelson J, Ron R, Tim B, James H., Fingers, Jay F, Dianne BS,Pulpit Forum, (oh yeh, Mitch J.also); The citizens of Greensboro are thoroughly ashamed of the way you manipulate lies and half truth with politically charged and racially divisive rhetoric. You are all responsible for the corruption in our City management and Police Dept., and all responsible for the Change in connotation of BLACK ACTIVIST. Whereas the term once described one who championed the cause of the disenfranchised and powerless YOU have made it to mean the same as KLAN MEMBER and NAZI. With you serving as the example, we shall teach our children that any kind of activist of your ilk, white or black, are no different than Hitler, Saddam, of any hood wearing Klan member. You continue to lie, cheat, and manipulate for personal gain. Why don't you just move away and leave Greensboro a peaceful future without your constant lies and racial inferiority complex.

to anon #7 and #8...oh my brother, but you do have an opinion even though you disguise it in long winded platitudes where you think you have the moral high ground...your problem is your writing style...it identifies you and reminds me of the skeletons you have in your closet...you have no creditability is this matter!!!

YeAH, WE ALL KNOW WHO THE GAS-BAG BROTHA BE. He rambles too much to hear himself talk.

As I have said before, Greensboro PD is headed down the road towards Durham and Washington DC. The race-based politics in the City and PD will continue as long as stupid guilt-ridden whites think they can buy inner-peace by giving away pieces of the City to blacks.

Before the gas-bag anon above gets fired up and lectures me from on-high, there are many many honorable and honest and solid hard working black folk....as there are shitty whites. The error this City makes is not maintaing a standard of excellence when making personnel decisions. Too often we make knee-jerk decisions and hire anyone with a pulse for fear of the "R" word being used. So sad.

I would just like to say that why,and I mean why do we let people like Mitch Johnson, the dirty cops wither W or B mess up our city. I have friends of all race, and we feel that the people need to push for the Mayor Johnson,Mitch Johnson City Mang. Also the dirty cops be brought B or W to Justice. But then they would be free under Ms. Wheaton Head of pre-trial release program is letting serious People charged with violant crims back on the streets just so she looks good with her little Pre trial program look good. She dosnet care that the UNCH and other students that were just killed where out on her so called"baby" Pretrial release program when they killed these students. But if you ever look at her up close you will see her leather like texture skin from chain smoking, and also the blood on her hands don't bother her as she sucks down her cosmos. My point here is people lets not let these scum bags who feel they are above the law tear down and try to split us the citizens on our good realationships which sees no colour, but rather let's bring them to justice. Starting with Mitch Johnson!!! Bless you all.

the citizens of Guilford county are lucky to have a public servant who does not give in to political pressure and will wait until all of the evidence at which time he will be able to make an informed decision about the case at hand

Anonymous said...

r u kidding... his decision has already been made this is just smoke and mirrows...this case needs to be sent to the grand jury for a true bill like fox and sanders then the good citizens of guilford county can decide their fate. a trial would help the city on either outcome...cause you know whats gonna happen next...law suit. the city might need to save their money in settling with the non-deserving black book officers cause this ones gonna cost...how ironic that if the black book officers get stiffed from their undeserved settlement it would be from one of their own.

Anonymous said...

r u kidding a grand jury. more like a rubber stamp. to bad you weren't in the book maybe you could make some money too

Anonymous said...

so whats your point...the gj is good enough for fox and sanders but not for wallace and his crew...if henderson is to scared to made a decision this is his out!!!

Anonymous said...

The black book is one of the biggest BS stories of the decade. NO ONE in the book suffered a civil wrong or injury, and therefore no one is deserving money.

Hinson was not in the book, so rule him out. Wallace was,,,,,cough cough cough. Maybe not by chance,,,was he the person that assualte the prostitute?
Another stupid exercise in PC by stupid guilt-ridden whites.

Anonymous said...

The black book is BS!! The pictures of these officers were used in an attempt to identify an officer accused of a crime. If a white officer had been accused then photos of white officers would have been used. If a female officer had been accused then the photos would have been of females. But instead an opportunity has been siezed to squeeze $ out of the city...and it's embarrassing that our city is stupid enough to allow it. In turn the accused idenified as a black male police officer gets away with wrong doing and Greensboro pays him for his actions!

Stop crying about the "Black Book."

If it was "no big deal," then why did people either resign or take early retirement before being confronted with the issue?

Why did Wray tell his friend to "hide it in the trunk" of a police car? The Black Book was real, GET OVER IT!

P.S.: And for the record, I heard of the book about a year & a half before it became "public knowledge."

so what your saying...is that some black officers have been involved or alledged to be involved in some type of conduct that may have been illegal or violated dd a year a half prior to the claim made by the prostitute.
humm...year and a half prior maybe before... this may have started under the white administration.

I hope Henderson CAN make a better decision faster when it comes to Animal abuse. This Animal abuser Jack McCall should be charged with a felony instead of a lighter sentence. Make this 3 time looser an example...Thanks to DDB (Dogs Deserve Better)Rep Shari Strader, Jack McCall Jr. in High Point, NC was caught on tape kicking, throwing, and choking chained dogs. http://www.myfoxwghp.com/myfox/MyFox/pages/sidebar_video.jsp?contentId=7152789&version=1&locale=EN-US He was charged with 3 counts of misdemeanor animal cruelty but was eluding police. He was finally arrested and had his preliminary hearing on Tuesday, August 12th. His court date is yet to be announced. Jack McCall has a history of animal abuse and dog fighting. Among multiple other charges, has been caught dog fighting and was convicted of misdemeanor animal cruelty in 2001. He obviously does not intend to stop. I ask that you call the Guilford County and High Point District Attorneys and tell them that Jack McCall should be charged with FELONY animal cruelty if you agree. Tell the DA's that McCall has established a pattern of abuse and will not stop until he is held accountable. Remind them of the link between animal abuse and child/spousal abuse.
